Abstract

Nusyuz in is the problematic of family law which is discussed in the Al-Quran, the problematic of nusyuz which is still partially understood; that nusyuz is an act of neglect of the obligations of husband and wife which causes a breakdown in relations in domestic life, provided that the act of nusyuz is carried out consciously with certain motives. Apart from that, nusyuz is carried out with the aim of maintaining the dignity of one of the parties. A wife is considered nusyuz if she leaves the corridor of qanitat and hafidzat. Meanwhile, a husband is considered nuzyuz if he is unable to direct his wife to achieve the identity of qanitat and hafidzat. The causes of nusyuz are stinginess and jealousy.Domestic violence is usually considered a hidden crime that has claimed quite a lot of victims from various levels of society. This can occur in various forms and be caused by various factors. As a result, suffering is not only experienced by the wife, but also the children because in the household there are certainly not only husbands and wives but also children who may see directly or at least hear acts of violence in the household. Therefore, in this study, as in legal research in general, the approach used is doctrinal research which aims to discover the principles or doctrines of positive law that apply in relation to the problem being studied, in the form of opinions and ideas from legal experts and interpreters. about husbands' limits in treating nusyuz wivesKeywords: Nusyuz; Islamic Law; Qur'an
